General terms and conditions for using the NLB Pay service
Article 1 Introductory Provisions
These general terms and conditions stipulate the rights and obligations of the User and the Bank for using the service of contactless card operations, including the NLB Pay service.
For the purpose of using the NLB Pay service these general terms and conditions are a constituent part of:
- General Terms and Conditions for the NLB Personal Account
- General Terms and Conditions for the NLB Business Account
- General Terms and Conditions for payment cards for natural persons - consumers
- General Terms and Conditions for the MasterCard Business Card
Below is a list of all general terms and conditions, together referred to as the General Terms and Conditions. The NLB Tariff, applicable at the time, is also a constituent part of the General Terms and Conditions.
The provisions of the General Terms and Conditions also apply to these general terms and conditions except where explicitly stated otherwise; in the case of discrepancies, these general terms and conditions shall prevail.
The terms used herein shall have the same meaning as the terms used in the General Terms and Conditions, unless explicitly agreed otherwise herein. Any terms not explicitly defined herein or in the General Terms and Conditions shall have the meaning stipulated in the provisions regulating payment services and system, applicable at the time.
Article 2 Definition of terms
Activation code shall mean a one-time password consisting of a string of characters received by the user via SMS to their mobile device which allows them to activate the NLB Pay mobile wallet;
Bank shall be NLB d.d.;
General terms and conditions shall be the General terms and conditions for using the NLB Pay service, applicable at the time;
User shall be a natural person - card holder - to whom the Bank issued a card;
Card shall be the payment instrument issued by the Bank to the User, which can be used for the NLB Pay service, namely:
- NLB Mastercard (NLB Prepaid Mastercard card is excluded)
- NLB Maestro
- NLB Visa
Flik is an interbank scheme, the list of banks members of the Flik scheme is available at www.flik.si.
Flik payment is a credit payment with the immediate settlement and approval of the payee's account and the transmission of a confirmation to the payer from the personal account under the Flik interbank scheme.
Licence Agreement shall be an agreement on the use of the mobile wallet licence, the owner of which is the company Vipera, and the agreement is binding for the user of NLB Pay service, who agrees with it entirely by agreeing to these General terms and conditions. The Licence Agreement is available at https://www.nlb.si/nlbpay-digital-licence.
NLB Pay service shall be the service of contactless payment by means of which the User can execute payments at POS terminals with cards stored in their NLB Pay mobile wallet and review the payment performed in the NLB Pay mobile wallet;
NFC (Near Field Communication) technology is the technology that enables the exchange of data between a mobile device and a POS terminal without a direct contact;
Mobile device shall be a mobile phone or a tablet with advanced functionalities, which supports the NFC technology and on which the appropriate version of the operating system is installed, allowing for the installation and use of the NLB Pay mobile wallet;
POS terminal shall be the device used for executing card payments at the points of sale, including ATMs, provided that it supports the use of the NFC technology
NLB Pay mobile wallet shall be the Bank’s application available in the Google Play mobile store and App Store, which is installed on the mobile device in line with the instructions for use of the NLB Pay mobile wallet. The list of operating systems which support the use of the NLB Pay mobile wallet is published on the Bank’s website.
Instructions for the use of the NLB Pay mobile wallet shall be the instructions published on the website http://www.nlb.si/pay
Security elements shall be the passwords and other security elements (e.g. fingerprint) intended for accessing the mobile device and activation of the NLB Pay mobile wallet each time
Article 3 Order and activation of the NLB PAY service
The User downloads the NLB Pay mobile wallet from the Google Play mobile store to their mobile device and registers by entering their tax number and the last 4 digits of one of the cards.
The mobile phone number kept by the Bank as their phone number shall be displayed to the User in the NLB Pay mobile wallet. If the displayed mobile phone number is not the user’s phone number kept by the Bank, the User will not be able to complete the procedure without informing the Bank about the correct phone number.
The Bank will send the activation code to the phone number, which the User will enter to activate the NLB Pay mobile wallet. The NLB Pay mobile wallet can only be activated if the User has enabled on their mobile device one of the methods of locking the mobile device with a security element which prevents third persons from using the mobile device.
The User can only use the NLB Pay service if the security element for accessing the mobile device is set at the moment of using the NLB Pay service.
Article 4 Card and Flik activation and payment using the NLB Pay service
Following successful activation of the NLB Pay mobile wallet, the User will be shown all cards they hold, which can be used for the NLB Pay service. Users who download the app from the App Store are only allowed to use Flik payments.
The User shall select one of the cards as the primary card. The user must activate the cards to be used for making the payments using the NLB Pay service in their NLB Pay mobile wallet.
The User sets the security element for each use of the NLB Pay mobile wallet in the NLB Pay mobile wallet in accordance with the instructions for the use of the NLB Pay mobile wallet and the functionalities of the mobile device (e.g. password, fingerprint).
To execute the payment transactions using the NLB Pay service at POS terminals with the primary card, the User must only unlock the mobile device; if the payment is made using a different card, the User must log into the NLB Pay mobile wallet with the security element and select a different card.
The user makes the payment by placing the mobile device in the proximity of the POS terminal. The General Terms and Conditions applicable to the selected card for the purpose of contactless payments shall apply to the execution of the payment transaction.
Article 5 Security of the NLB Pay mobile wallet and mobile device
The User undertakes to:
- take good care of and protect the mobile device as a good manager, i.e. by preventing it from being lost, stolen and/or abused and not allowing its use by third persons, as well as assuming liability for any damage suffered due to the fact that the User’s mobile device had been used by third persons,
- take good care of all security elements used for accessing the mobile device and using the NLB Pay mobile wallet as a good manager, i.e. by preventing them from being lost, stolen and/or abused and not communicating them, showing them or allowing their use by third persons, as well as assuming liability for any damage suffered due to the fact that the security elements had been used by third persons,
- take care that the NLB Pay mobile wallet is removed from the mobile device on which it is installed when such mobile device is no longer used by the User and follow the instructions for the activation of the NLB Pay mobile wallet on another device in accordance with the instructions for the use of the NLB Pay mobile wallet,
- inform the Bank, via an NLB Branch Office or NLB Klik on-line bank or in another manner provided by the Bank for submitting data and identification, of any change related to the mobile phone number,
- secure access to their mobile device with a security element and not leave the mobile device with activated NLB Pay mobile wallet unprotected,
- use the NLB Pay mobile wallet in accordance with the instructions for the use of the NLB Pay mobile wallet, the provisions hereof, the General Terms and Conditions and the applicable legislation,
- respect the Licence Agreement for mobile wallet, in particular in terms of the download, installation and use of the NLB Pay mobile wallet,
- immediately inform the Bank, without delay, of any irregularities in the functioning of the NLB Pay mobile wallet,
- not to use or install on the mobile device any computer codes, malware or anything that could disrupt, disable or harm the NLB Pay mobile wallet or the communication network; should the User cause damage with their actions, they shall assume full responsibility to the Bank as well as the mobile operator,
- without delay inform the bank of any unauthorised use, suspicion of unauthorised use or possibility of unauthorised use of the mobile device (e.g. if a third person has in any way found out about the security elements that could be used by them), theft or loss of the mobile device, and in such case request that the NLB Pay mobile wallet be frozen,
- monitor the notices in the Google Play mobile store and App Store on the mobile device and download new versions of the NLB Pay mobile wallet,
- regularly monitor the Bank’s notifications, related to the use of the NLB Pay service via the NLB Pay mobile wallet or the Bank’s website (http://www.nlb.si/pay),
- stay informed of the list of countries and/or regions that are subject to the prohibition or limitation of card operations published on the international scheme websites and not to activate or use the NLB Pay mobile wallet in such countries and/or regions.
To activate Flik payments, you will need to confirm your Flik payment contact information and confirm your consent to use your contact information for Flik payment purposes.
The user can perform the following Flik payment services via NLB Pay:
• make a Flik payment;
• send request requests to pay;
• receive Flik payments;
• receives requests to pay;
• overview of Flik payments status made with the NLB Pay application;
• manage contact information for Flik payments.
Article 6 Freezing of the NLB Pay mobile wallet or freezing of payments made by using the NLB Pay service and termination of the use of NLB Pay mobile wallet
The Bank shall be entitled to prevent the User’s access to the NLB Pay mobile wallet or the NLB Pay service in relation to any or all cards at any time, if:
- there is any suspicion whatsoever of unauthorised access to the NLB Pay mobile wallet,
- the User’s mobile device had been lost or stolen,
- the User failed to download the new version of the NLB Pay mobile wallet, when available,
- this is in line with the General Terms and Conditions applicable to individual cards,
- the User violates these general terms and conditions or the General Terms and Conditions,
- the Bank no longer provides the NLB Pay service.
The User cannot stops using the NLB Pay service by removing the NLB Pay mobile wallet from their mobile device. Official termination from the usage of NLB Pay can be done in NLB Branches, through mobile banking services NLB Klik or any other bank’s channel.
Article 7 The Bank’s obligations and disclaimer
The Bank undertakes to:
- perform its obligations in accordance with these General Terms and Conditions,
- inform the User of any amendment or supplementation of these general terms and conditions and the NLB Tariff in accordance with the General Terms and Conditions.
The Bank shall not be held liable for damage arising from the reasons that are outside its control, which the Bank was unable to prevent or avoid, such as for example telecommunications infrastructure failure.
Article 8 Data protection
By activating the NLB PAY mobile wallet, the User explicitly agrees with the processing of their personal data in line with the General Terms and Conditions.
Article 9 Amendments to these general terms and conditions
The Bank shall be able to change the General Terms and Conditions at any time and publish the updated version on its website and in the application enabling the use of the Mobile Wallet. The User shall accept the change in the general terms in the application before or with continued use of the mobile wallet.
The Bank shall be entitled to disable the use of the NLB Pay mobile wallet if the User fails to agree with the amended General Terms and Conditions in the application.
Article 10 Fees
The Bank shall charge the User for the fees and charges related to the use of the NLB Pay service in accordance with the applicable NLB Tariff and the General Terms and Conditions. The use of the NLB Pay mobile wallet may involve the cost of mobile data transfer.
These general terms and conditions shall apply as of May 27th 2020 and shall be available to users in the NLB’s branch offices and on the Bank's website.
